**Unofficial translation of Penal Code, art. 615.5**

"Article 615-quinquies of the Penal Code (Spreading of programs aimed at damaging or interrupting a computer system).
Anyone who spreads, transmits or delivers a computer program, whether written by himself or by someone else, aimed at or having the effect of damaging a computer or telecommunication system, the programs or datacontained in or pertaining to it, or interrupting in full or in part or disrupting its operation is punished with the imprisonment for a term of up to two years and a fine of up to It. L. 20,000,000."

La legge 23 dicembre1993, n. 547, ha introdotto nel nostro ordinamento penale norme che espressamente riguardano i virus, modificando il codice penale in vari punti. Riportiamo per brevita' l'art. 392, cui e` stato aggiunto l'ultimo comma, e l'articolo 615-quinquies, introdotto dalla legge:
392.Esercizio arbitrario delle proprie ragioni con violenza sulle cose.
Chiunque al fine di esercitare un preteso diritto, potendo ricorrere al giudice ä c.p.c. 99ã, si fa arbitrariamente ragione da sé medesimo, mediante violenza sulle cose ä c.c. 896, 1152 ã, è punito a querele della persona offesa, con la multa fino a lire un milione ä c.p.120,126; c.p.p. 336 ã (1).
Si ha, altresì, violenza sulle cose allorché un programma informatico viene alterato, modificato o cancellato in tutto o in parte ovvero viene impedito o turbato il funzionamento di un sistema informatico o telematico (2).
(1) La multa risulta aumentata, da ultimo, ai sensi dell’art.113, L.24 novembre 1991,n.689, che modifica il sistema penale.
(2) Comma aggiunto dall’art. L. 23 dicembre1993, n. 547, che modifica ed integra le norme del codice penale e del codice di procedura penale in tema di criminalità informatica.

615-quinquies.Diffusione di programmi diretti a danneggiare o interrompere un sistema informatico. Chiunque diffonde, comunica o consegna un programma informatico da lui stesso o da altri redatto,avente per scopo o per effetto il danneggiamento di un sistema informatico o telematico, dei dati o dei programmi in esso contenuti o ad esso pertinenti, ovvero l’interruzione, totale o parziale,
o l’alterazione del suo funzionamento, è punito con la reclusione sino a due anni e con la multa sino a lire venti milioni (1).
